| This research aims to contribute to the debate of i jtihad bycomparing the views of i jtihad between two scholars that lived in theNorth Africa in different centuries. One of the fuqaha who is the subjectof our research is Ibn Ebil-Izz el-Hanefi and the other is Mohammad b.Alı al-Sanusi. Both scholars tended towards ittibâand i jtihad ratherthan imitation (taqlid) and bigotry by opposing the predominant law con- ception during their periods. However, it seems that these fuqaha at- tempted to i jtihad regardless of the political, legal and social conditionsof their periods. but the religious and dignitaries of theır perıod thoughtthat these fuqaha wanted to make the legal system a dysfunctional one,to eliminate the legal entity and consequently thıs would increase theseparation of the ummah further. As a result, sınce the condıtıons haveyet to take root for an ı jtıhad, the attempts of these two scholars werenot sufficient to change the tack of the historical process. But theybecame pioneers of the debates of reformation and tajdid made at theend of the 19th and at the begining of the 20th centuries |
